Getting eventually paid by companies (legal services)

Regularly, AIC is informed of companies not paying their experts at the end of their assignments. Amounts involved are generally a few thousands euros, but may reach several 10 thausends euros.

For example, an Italian expert employed by a company from the Netherlands to work in Central Europe will see in his contract the following sentence (or a similar one): "All claims or settlements resulting from this contract will take place in the Netherlands" It means that this Italian citizen, if not paid at the end of his assignment, has to identify a lawer in The Netherlands to sue the company in this same country.

Too often, experts are hesitating to sue a company, because of the cost involved but especially because of their lack of knowledge concerning the laws of the concerned country and the difficulty to identify the appropriate lawer in this foreign country.

Experience shows that almost all companies will eventually pay the experts when sued. This is why AIC is trying to establish for each country a list of lawyers ready to sue a companies not paying their experts in due time at the end of their assignments. The idea is of course to have these same lawers (1 or 2 per country) to deal with all cases related with any company of a specific country.

Remember that the non payment of experts at the end of their assignment is amongst others one of the sufficient reason for a company to be introduced on the AIC Watchlist of Companies or, even worse, on the AIC Blacklist of Companies. When a company is using unfair or even (in some cases) crook methods, it has to be known from all experts, if they do not want to be fooled.
